1. Introduction

Welcome to Rewarding Progress (“Platform”), a reward-based crowdfunding platform. These Terms and Conditions (“Terms”) govern your use of the Platform and the services provided. By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Platform.

2. Definitions

  • “Campaign Owner”: An individual or entity seeking funding through the Platform.
  • “Backer”: An individual or entity providing funds in exchange for rewards.
  • “Reward”: Goods, services, or experiences offered by Campaign Owners to Backers.
  • “User”: Any person accessing or using the Platform, including Campaign Owners and Backers.
  • “Platform Services”: The services provided by Rewarding Progress to facilitate crowdfunding campaigns.

3. Eligibility

To use the Platform, you must:

  • Be at least 18 years old;
  • Have the legal capacity to enter into contracts under Malaysian law; and
  • Ensure that your use of the Platform complies with all applicable laws and regulations.

4. Account Registration

Users must create an account to access certain Platform features. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain the confidentiality of your account credentials; and
  • Notify us immediately of any unauthorized use of your account.

5. Campaign Creation

Campaign Owners agree to:

  • Accurately describe their campaign, including the purpose, funding goals, timeline, and Rewards;
  • Fulfill all promises made to Backers, including delivering Rewards; and
  • Comply with all applicable laws and regulations.

6. Backer Contributions

Backers understand and agree that:

  • Contributions are voluntary and non-refundable unless stated otherwise;
  • The Platform does not guarantee the successful delivery of Rewards; and
  • Backers contribute at their own risk.

7. Fees and Payments

  • The Platform charges a service fee on the funds raised by Campaign Owners, as outlined in our Fee Schedule.
  • All payments are processed through third-party payment processors. The Platform is not responsible for payment processing errors or issues.

8. Intellectual Property

  • Campaign Owners retain ownership of their intellectual property but grant the Platform a non-exclusive license to use content provided for promotional purposes.
  • Users may not infringe on the intellectual property rights of others while using the Platform.

9. Prohibited Activities

Users may not:

  • Use the Platform for illegal, fraudulent, or deceptive purposes;
  • Misrepresent information in their campaigns or contributions; or
  • Engage in activities that disrupt the Platform’s functionality.

10. Liability and Disclaimers

  • The Platform acts solely as an intermediary and is not responsible for the actions of Campaign Owners or Backers.
  • The Platform disclaims all liability for any loss or damage arising from the use of the Platform, to the extent permitted by Malaysian law.

11. Termination

We reserve the right to suspend or terminate your account or access to the Platform if you violate these Terms.

12. Privacy

Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these Terms shall be resolved in Malaysian courts.

14. Modifications

We reserve the right to amend these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised Terms.

15. All-or-Nothing Campaigns

For campaigns under the tag “All or Nothing,” if the funding goal is not reached by the campaign time limit, the funds will be reimbursed to the Backers. However, the reimbursed amount may not be the full contribution due to payment provider charges that are non-refundable.
